All photographs, images, logos, and content are copyrighted by By Seanzky.
You may not:

• Reproduce
• Edit
• Distribute without written permission.
Purchase of portraits does not transfer copyright ownership.
2.3 Limitation of Liability
By Seanzky is not liable for:
• Website outages
• Third-party service interruptions
• Indirect damages
Maximum liability is limited to the amount paid for services or products.
2.4 Governing Law
These Terms are governed by the laws of the State of Texas.
3. Refund & Delivery Policy
3.1 Digital Products
All digital portrait purchases are final sale and non-refundable once delivered.
Additionally, we do not offer refunds for:
• Incorrect e-mail address provided
• Delays caused by internet connectivity issues
3.2 Physical Products
If a physical product arrives damaged:
• You must notify us within 7 days of delivery.
• Photographic proof of damage is required.
• We will offer a replacement at no additional charge.
We do not offer refunds for:
• Buyer’s remorse
• Incorrect address provided
• Delays caused by shipping carriers
3.3 Shipping
• Orders are processed within 5–10 business days unless otherwise stated.
• Shipping times vary depending on carrier.
• By Seanzky is not responsible for delays caused by carriers, weather, or customs (if applicable).
Tracking information will be provided if/when available.
4. Delivery Timeline Clause
(For Client Agreements)
Unless otherwise specified in writing:
• Proof gallery delivered within 14–21 business days after session.
• Final edited images delivered within 7–14 business days after client selection.
• Rush delivery may be available for an additional fee.
Delivery timelines may be extended during peak seasons or due to unforeseen circumstances.
5. Minor Consent Section
If the subject photographed is under 18 years of age:
The parent or legal guardian signing the agreement certifies that:
• They are the legal guardian of the minor.
• They grant permission for photography services.
• They authorize image use according to the Model Release section below.
By Seanzky reserves the right to request proof of guardianship.
6. Model Release Clause
Client grants By Seanzky the irrevocable and unrestricted right to use photographs taken during the session for:
• Portfolio
• Website
• Social media
• Advertising
• Marketing materials
Images may be edited for artistic or layout purposes.
No additional compensation will be provided for promotional use.
If Client does not wish for images to be used for
promotional purposes, a written request must be submitted prior to the session.
7. Full Photography Client Contract
Photography Services Agreement

7.2 Payment Terms
• A non-refundable retainer of $__________ is required to secure booking.
• Remaining balance due before or on session date.
• Failure to pay may result in cancellation or withholding of images.
7.3 Cancellation & Rescheduling
• Retainer is non-refundable.
• One reschedule permitted with 48-hour notice.
• No-shows forfeit retainer.
7.4 Artistic Discretion
Client acknowledges that photography is subjective and agrees to accept Photographer’s artistic style.
7.5 Image Delivery
Delivery follows the timeline stated in Section 4 above.
RAW/un-edited images are not provided.
7.6 Copyright
Photographer retains full copyright ownership.
Client receives a personal-use license unless otherwise agreed in writing.
Commercial use requires separate licensing agreement.
7.7 Limitation of Liability
In the unlikely event of equipment failure, loss of images, or unforeseen circumstances, liability is limited to refund of payments made.
7.8 Minor Consent & Model Release
Client agrees to Sections 5 and 6 above.
7.9 Entire Agreement
This Agreement constitutes the entire understanding between parties.
